Terms & Conditions of Participation in the Ganjika House Ganjika Coin Loyalty Program

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ENTERING THE GANJIKA HOUSE GANJIKA COIN LOYALTY PROGRAM. YOU AGREE TO BE BOUND BY THESE TERMS AND ALL TERMS INCORPORATED BY REFERENCE BY PARTICIPATING IN THIS PROGRAM. DO NOT PARTICIPATE IN THIS PROGRAM IF YOU DO NOT AGREE TO ALL OF THESE TERMS.

1. Eligibility and Overview of Membership

1.1. C.G.S. Foods oa Ganjika House ("Ganjika House," "we," "our," or "us") offers the Ganjika Coin Loyalty Program ("Program") at its sole discretion. Individuals may only participate in the Program for their own personal use, and each person is only allowed one account. The Program is not open to corporations, associations, or other organisations. Individuals who are legal residents of Ontario, have reached the age of 19+, and have a valid email address and phone number are eligible to join. It is not essential to make a purchase in order to participate in the Program. The Program cannot be used for any commercial or business purposes, and we have the right to refuse to create an account for any reason. Employees of Ganjika House, as well as those employed by our business partners or vendors, are eligible for personal membership but may be barred from certain Program advantages.

1.2. You (individually and collectively, "you," "your," or "Member") agree that you have read, understood, and agree to be bound by these Program Terms and Conditions of Participation ("Program Terms"), as well as any changes or modifications we may make, by joining the Program and becoming a Program member. You should examine these Program Terms on a regular basis to ensure that you are aware of any changes to the terms and circumstances that apply to the Program. The terms and conditions of any other agreement you may have with us, including any arrangement for products or services, are unaffected by these Program Terms. You agree to be governed by our website Privacy Policy and Terms of Service, which are incorporated herein by reference, by enrolling in the Program. You will not be able to participate in the Program if you do not agree to these Program Terms, our website Privacy Policy, and our website Terms and Conditions. Wherever the law forbids it, the Program is void.

2. Enrollment in the Program

2.1 Eligible individuals may only register for the Program by going to www.Ganjika-House.com (collectively, the "Site") or visiting a participating location and following the Program procedures.

2.2. In order to enrol in the Program, you must register an account by providing your name, email address and creating a password. You may also be required to provide us with your mailing address, birth date, and cell phone number. You are solely responsible for keeping your account information accurate and amending it as needed. On the Site, you can make changes to your personal information.

2.3. A single individual, a single phone number and a single email address can only have one Program account. If there is a disagreement about who owns the Program membership account, the member shall be considered the authorised account holder of the email address provided at the time of enrolment. The "authorised account holder" is the natural person who is assigned to the submitted email address by an internet provider, online service provider, or other organisation (e.g., business, educational institution, etc.) responsible for assigning email addresses for the domain associated with the submitted email address for the purposes of these Program Terms.

3. The Program's Operation

3.1. The Program is a method for us to acknowledge and reward our loyal consumers for visiting our stores and providing information to us. By visiting stores or engaging in certain other Program activities, you can earn points.

3.3. To qualify for the Program, you must be enrolled in the Program and provide your Program Member Username, phone number or other identifying information that we specify when visiting a qualifying retailer (“Qualifying Visit”)

3.3.1. Members earn one (1) Point for every Qualifying Visit to a participating retail store location, with a limit of one Qualifying Visit per participating retail store location per day. Once a member accumulates 10 Points, they can redeem such for a Reward, namely one (1) 10% discount on one (1) purchase transaction of Qualifying Products, and the Member’s Points balance will reset to zero. Ganjika House in its sole discretion determines what items are Qualifying Products, and Ganjika House reserves the right to modify this from time to time in its sole discretion. Members may not redeem any Points balance of less than 10 Points.

3.3.2. During your Qualifying Visit, to earn Points you must perform the acts specified by Ganjika House or the participating retail store (“Reward Actions”). This may include providing information, including but not limited to consumption, shopping, demographic, geographic and behaviour information, as well as other information that may be considered personal information under applicable law (“Supplied Information”). Supplied Information or any information we generate or derive as a result of your participation in the Program (“Program Information”) may be provided, transferred, sold or otherwise disclosed to third parties for commercial, marketing and/or promotional purposes. The collection, use and disclosure of any Supplied Information and Program Information is governed by our Privacy Policy [LINK TO PRIVACY POLICY], as amended from time to time, which you accept to be bound by.

3.3.3. Ganjika House may offer multiple Reward Actions, including Reward Actions that may award a member more than (1) one Point. Ganjika House determines the number of points awarded for each action, if any, in its sole discretion, as well as the frequency and number of Reward Actions that can be earned per person or in a single Qualifying Visit.

3.3.4 Ganjika House may limit the number of redemptions a member may make in 12-month period or calendar year. Any accrued points expire after a 12 month-period in which the Member does not redeem Points.

3.4. For further certainty, purchases made at participating retail locations will not earn points or provide benefits to members. No purchase is necessary to earn points. The Program does not apply to purchases made in retail stores outside of Ontario. Points cannot be redeemed for cash. Offers and prizes are available while supplies last, and we reserve the right to make substitutes at our discretion.

3.5. The Program is not intended to be open to any individual that is not 19 years of age or older. If we suspect you are under the age of 19 or earning or redeeming points on behalf of someone under the age of 19, we reserve the right in our sole discretion to remove you from our Program.

4. Points Value

4.1. Accounts, Program prizes, advantages, and/or points are not transferable, shareable, or combinable. Rewards, perks, and/or points can only be accumulated by the member who visits the respective participating retail store and completes one or more Reward Actions. We reserve the right to keep track of the number of accounts per household and, at any moment, refuse, merge, or close new or duplicate accounts. Your account information (including security information) is private and should not be shared with anyone else.

4.2. The Program's awards, advantages, and/or points have no monetary value, are non-transferable, and you have no ownership or property rights in or to the rewards or other Program benefits. If part or all of your purchase is returned or cancelled, or if the credit is earned by fraudulent or other activity that violates these Program Terms, the points credited to your Program account will be reduced or reversed, as appropriate. It is explicitly forbidden to sell, barter, transfer, or assign any awards, benefits, or points obtained through the Program to anyone other than us.

4.3. Reward points cannot be exchanged or returned for points, cash, rebates or a monetary refund.

4.4. The Program's products and services are for personal use only. You are not permitted to sell or resell any of the items, services, or products you purchase or get from us. We reserve the right to cancel or reduce the quantity of any order to be filled, and/or any products or services to be given to you, without notice, if we feel, in our sole judgement, that such action may result in a breach of our Program Terms.

4.5. We are not responsible for any lost or redeemed prizes, bonuses, or points as a result of fraudulent acts by you or any third party.

4.6. We have the right to change Program features, including how you earn points, what the points can be redeemed for and how points are redeemed, and how we evaluate and reward your qualified purchases and/or other Program activities. We reserve the right to limit the number of store visits or activities that are eligible for the Program, the number or types of rewards or benefits you may receive or earn in any given tier or point level, in a given time period or for the duration of the Program, and/or any combination thereof.

4.7. If you have any questions or concerns about a purchase or other activity not being properly credited to your account, please contact Ganjika House at hello@Ganjika-House.com. Your email must include your name and email address, as well as the date of the Program activity and the issue(s) you encountered. This email must be delivered within 15 days of the date on which the impugned Program activity occurred. We are not liable for any late notices regarding purchases or other Program activity that are not credited to an account.

4.8 Unless Ganjika House specifies differently, rewards can only be claimed in participating retail stores.

5. Marketing and Public Relations

5.1. You will automatically receive Program-related emails, such as Program marketing emails and information regarding your Ganjika House account, rewards, and advantages, if you enrol in the Program. At the time of enrolment, we may also provide you the choice to opt-in to receive further Ganjika House marketing materials.

5.2. You may unsubscribe from Ganjika House marketing emails at any time by following the instructions in the email or as otherwise indicated in the Ganjika House Privacy Policy, but operational communications related to your membership in the Program will continue to be sent to you. These can include, but are not limited to, a redemption confirmation email, a new point acquisition email, a profile change email, or other account-related emails. You will no longer receive Program-related messages if you cancel your Program membership. If you unsubscribe from Program-related marketing communications, you will no longer receive emails about potential Program awards or perks.

Termination and Modification

6.1. We offer the Program and its advantages in our exclusive discretion. We reserve the right to cancel, modify, restrict, or terminate these Program Terms, or any aspect or feature of the Program at any time and without notice, even if such changes may affect the value of rewards or benefits already accumulated or earned, as well as the ability to redeem accumulated rewards or benefits.

6.2. We reserve the right, in our sole discretion, to exclude you from or cease your participation in the Program, as well as to amend or remove your membership account. You must check in to your Program account and make a redemption within 12 months to keep your account active. Any suspected abuse of the Program, failure to follow any Program Terms, membership inactivity for more than 12 months, illegal activity, fraud, misrepresentation, or other conduct inconsistent with these Program Terms and/or detrimental to us or our interests, including without limitation, any suspected illegal, fraudulent, or unauthorised use of any Program rewards, points, cards, credits, vouchers, coupons, and/or certificates, may result in your membership being revoked. Any prizes or advantages in your account will automatically expire if your membership is revoked, as will your access to the Program and features. We also have the right, in our sole discretion, to take appropriate legal action if we suspect illegal behaviour, fraud, misrepresentation, abuse, or a violation of these Program Terms.

6.3. You may cancel your membership in the Program at any time by opting-out in your account on the Site or by contacting hello@ganjika-house.com. You will lose all accrued points and rewards if you terminate your membership, and your tier status will automatically expire.

7. Disclaimer of Warranties; Liability Limitation

YOU AGREE THAT:

7.1. GANJIKA HOUSE AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, PARTNERS, AND LICENSORS MAKE NO REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND IN RESPECT OF THE PROGRAM, THESE TERMS, OR ANY OF THE REWARDS, BENEFITS, OR POINTS ASSOCIATED WITH THE PROGRAM, INCLUDING WARRANTIES OF MERCHANTIBILITY, EXCEPT TO THE EXTENT SUCH REPRESENTATIONS AND WARRANTIES ARE NOT LEGALLY EXCLUDED BY APPLICABLE LAW.

7.2. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEITHER GANJIKA HOUSE NOR ITS PARENTS, SUBSIDIARIES, AFFILIATES, PARTNERS, OR LICENSORS SHALL BE RESPONSIBLE OR LIABLE, WHETHER IN CONTRACT, TORT OR OTHERWISE INCLUDING NGELIGENCE FOR ANY (a) DELAYS OR INTERRUPTIONS RELATED TO THE PROGRAM; (b) NON-DELIVERY, LOSS, THEFT, MISDELIVERY, CORRUPTION, DESTRUCTION, OR OTHER MODIFICATION OF THE PROGRAM OR ITS DATA; (c) LOSS OR DAMAGES OF ANY KIND INCURRED ON RESULT OF DEALINGS WITH OR THE PRESENCE OF THIRD PARTY; or (d) INTERRUPTION TO BUSINESS

7.4. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEITHER GANJIKA HOUSE NOR ITS PARENTS, SUBSIDIARIES, AFFILIATES, PARTNERS, OR LICENSORS WILL BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND RELATED TO THE PROGRAM OR YOUR PARTICIPATION IN IT, REGARDLESS OF THE FORM OR CAUSE OF ACTION WHETHER IN CONTRACT, TORT OR OTHERWISE, INCLUDING NEGLIGENCE, EVEN IF YOU HAVE BEEN ADVISED OF SUCH DAMAGES. IN NO EVENT SHALL OUR MAXIMUM AGGREGATE LIABILITY EXCEED TEN DOLLARS CANADIAN ($10.00).

7.5. YOUR SOLE REMEDY IF YOU HAVE A DISPUTE WITH US OR ARE DISSATISFIED WITH THE PROGRAM IS TO TERMINATE YOUR MEMBERSHIP IN THE PROGRAM. WE OWE YOU NO OTHER OBLIGATIONS, LIABILITIES, OR RESPONSIBILITIES.

8. Indemnification

You agree to defend, indemnify, and hold us, our parents, subsidiaries, affiliates, partners, licensors, officers, directors, employees, and agents harmless from any loss, damages, or costs resulting from any third-party claim, action, or demand resulting from your participation in the Program or your breach of any of these Program Terms, including reasonable lawyers’ fees.

9. Dispute Resolution and Governing Law

This Program and these Terms will be governed and construed in accordance with the laws of the province of Ontario and the laws of Canada applicable therein.

10. Confidentiality

We will use and disclose the personal information we collect from you in connection with the Program, including but not limited to purchases made in conjunction with your Program participation, in line with the Ganjika House Privacy Policy.
